In any organisation, people are the driving force behind productivity. Ensuring their safety and well-being is paramount, which is why the Occupational Health and Safety (OHS) Act mandates training in the workplace. Enacted in 1993, this legislation protects employees and others in the workplace from potential hazards.
Purpose of the OHS Act
At its core, the OHS Act aims to safeguard the health and safety of individuals at work and those affected by work-related activities. It sets standards for creating healthy work environments and preserving employees’ ability to work effectively. Applicable to a wide array of industries, from offices to construction sites, this Act regulates health and safety practices across South Africa.
Employer Responsibilities
Employers bear the primary responsibility for ensuring compliance with the OHS Act. Section 8 outlines their duties, which include developing and implementing a comprehensive health and safety policy. Risk assessments, precautionary measures, and incident reporting are also part of their mandate. Employers must appoint health and safety supervisors and educate employees about workplace hazards.
Employee Duties
Section 14 emphasizes employees’ duty to prioritise their own safety and that of their colleagues. They must adhere to safety protocols set by the employer and report any unsafe conditions promptly. Employees are obligated to comply with the OHS Act’s recommendations and promptly report incidents or hazards they encounter.
